Introduction

This Privacy Policy (“Policy”) describes how AdFree Tools (“Company”, “we”, “us”, or “our”) collects, uses, stores, shares, and protects information obtained from users (“you”, “your”, or “User”) of the Swiipy mobile application (“App”, “Service”, or “Platform”).

By downloading, installing, accessing, or using Swiipy, you expressly acknowledge that you have read, understood, and agree to be bound by this Privacy Policy in its entirety. If you do not agree with any part of this Policy, you must immediately stop using the App and delete your account.

Swiipy is a social networking and dating platform. We act solely as a technology intermediary that provides a platform for users to connect. We are not a matchmaking service, and we do not guarantee any outcome, match, relationship, or interaction resulting from the use of our App.

1. Eligibility & Age Requirements

Swiipy is strictly intended for users who are at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is greater). By creating an account, you represent and warrant that:

• You are at least 18 years old or the age of majority in your jurisdiction
• You are legally capable of entering into a binding agreement
• You are not prohibited from using the Service under applicable laws
• You have not been previously banned or removed from the Platform
• You do not have any unspent criminal convictions related to violent, sexual, or harassment offenses

We reserve the right to request proof of age at any time and to terminate accounts that we reasonably believe belong to users under the age of 18. The Company is not responsible for any consequences arising from a minor's use of the Platform obtained through misrepresentation of age.

4. Subscriptions, Payments & Pricing

Swiipy offers both free and premium (paid) features. The availability, pricing, and scope of free and paid features may vary based on factors including but not limited to user demographics, location, and promotional offers.

The Company reserves the right to modify pricing, features, and access levels at any time without prior notice. Changes to subscription terms will be communicated through the App or via email. Continued use of the Service after such changes constitutes acceptance of the new terms.

Payment processing is handled by third-party providers (Apple App Store, Google Play Store, Stripe, etc.). We do not store your full credit card numbers or banking information. All payment data is subject to the respective payment provider's privacy policy.

Refund policy: All purchases are final unless otherwise required by applicable law. Subscriptions renew automatically unless cancelled before the renewal date. You are solely responsible for managing your subscription and cancelling before any renewal period.

We may share your information with:

• Other Users: Your profile information, photos, and public content are visible to other users of the Platform as part of the core functionality
• Service Providers: Third-party vendors who assist in operating the Service (hosting, analytics, payment processing, customer support, fraud prevention)

• Safety & Enforcement: To protect the rights, property, or safety of the Company, its users, or the public

By using Swiipy, you acknowledge and accept that your profile and certain information will be visible to other users. You are solely responsible for the information you choose to share on your profile and in your interactions.

6. User Responsibilities & Conduct

You are solely and entirely responsible for your conduct, interactions, and communications on and through the Platform. By using Swiipy, you agree to the following:

• All information you provide is truthful, accurate, and not misleading
• You will not impersonate any person or entity, or misrepresent your identity, age, or affiliation
• You will not use the Platform for any illegal, fraudulent, or harmful purpose
• You will not harass, stalk, threaten, intimidate, or abuse any other user
• You will not send unsolicited commercial content, spam, or promotional material
• You will not upload content that is illegal, defamatory, obscene, violent, exploitative, or that violates the rights of any third party
• You will not attempt to extract, scrape, or collect data from other users or the Platform
• You will not use the Platform to solicit money, services, or anything of value from other users
• You are solely responsible for your own safety when meeting or interacting with other users, whether online or in person
• You will exercise caution and good judgment in all interactions with other users

The Company does not conduct criminal background checks, identity verification beyond basic account creation, or screening of users. We do not verify the statements or claims made by users on their profiles. The Company makes no representations or warranties regarding the character, integrity, behavior, or intentions of any user.

You acknowledge and agree that the use of a dating and social networking platform involves inherent risks, including but not limited to the risk of interacting with persons who may be dishonest, harmful, or dangerous.

By using Swiipy, you voluntarily assume all risks associated with:

• Interactions and communications with other users
• In-person meetings with individuals met through the Platform
• Disclosure of personal information to other users
• Emotional or psychological impact of using the Service
• The possibility of encountering false, misleading, or fraudulent profiles
• The possibility of encountering minors who have misrepresented their age
• Any financial loss resulting from interactions with other users

The Company strongly recommends that you exercise extreme caution when communicating with and meeting other users. Never share financial information, home address, or other sensitive details with users you have not met in person and thoroughly verified.

9. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, partners, licensors, and suppliers from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:

• Your use or misuse of the Service
• Your violation of this Privacy Policy or any applicable Terms of Service
• Your violation of any applicable law, regulation, or third-party rights
• Any content you post, upload, or transmit through the Service
• Your interactions with other users, whether online or offline
• Any dispute between you and any other user
• Any misrepresentation made by you

This indemnification obligation shall survive the termination of your account and/or your use of the Service.

You retain ownership of the content you post on Swiipy. However, by posting, uploading, or sharing content on the Platform, you grant the Company a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, display, and distribute such content in connection with operating and promoting the Service.

You represent and warrant that you own or have the necessary rights to all content you post, and that such content does not violate any law or infringe upon the rights of any third party.

We reserve the right to remove, modify, or restrict access to any content at our sole discretion, without prior notice and without liability, for any reason including but not limited to content that violates this Policy or our community guidelines.

11. Data Security

We implement commercially reasonable technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

The Company shall not be liable for any damages, losses, or consequences resulting from a security breach, data leak, or unauthorized access to your data, except where such breach is directly and solely caused by the Company's gross negligence or willful misconduct.

12. Data Retention & Deletion

We retain your personal data for as long as your account is active and as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements.

Upon account deletion, we will delete or anonymize your personal data within a reasonable timeframe, except where retention is required or permitted by law (e.g., for fraud prevention, legal proceedings, or regulatory compliance). Some data may be retained in anonymized or aggregated form for analytics purposes.

Messages and content you have sent to other users may remain visible to those users even after your account is deleted. We cannot control or delete data that other users have saved, screenshotted, or shared outside the Platform.

13. Location Data

Swiipy may collect and use your location data (with your consent) to provide location-based features, including showing you users nearby. You can disable location access through your device settings at any time, but this may limit the functionality of the App.

The Company is not responsible for any consequences arising from the display of your approximate location to other users. You acknowledge that using location-based features inherently involves disclosing your general location to other users.

The App may contain links to or integrate with third-party websites, services, or applications. We are not responsible for the privacy practices, content, or security of any third-party service.

We may use the following categories of third-party services:

• Analytics providers (to understand usage patterns)
• Payment processors (to handle subscriptions and purchases)

• Fraud detection and prevention services

You may opt out of promotional communications at any time by updating your settings or using the unsubscribe mechanism provided. Service-related communications (e.g., security alerts, account changes) cannot be opted out of while you maintain an active account.

We reserve the right to suspend, restrict, or terminate your account at any time, for any reason or no reason, with or without notice, and without liability. This includes but is not limited to violations of this Policy, reports from other users, suspected fraud, or any behavior we deem harmful to the Platform or its users.

Upon termination: (a) your right to use the Service immediately ceases; (b) we may delete your data in accordance with Section 12; (c) no refund will be issued for any unused portion of a paid subscription, unless required by applicable law.

17. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to this Policy, the Service, or your use of the App shall be resolved through binding individual arbitration, except where prohibited by applicable law.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against the Company.

Before initiating arbitration, you agree to first attempt to resolve the dispute informally by contacting us at contact@swiipy.com. If the dispute is not resolved within thirty (30) days, either party may proceed with arbitration.

Depending on your location, you may have certain rights regarding your personal data, including:

• Right of Access: Request a copy of the personal data we hold about you
• Right to Rectification: Request correction of inaccurate or incomplete data
• Right to Erasure: Request deletion of your personal data (subject to legal exceptions)

Swiipy is not intended for and must not be used by anyone under the age of 18. We do not knowingly collect personal information from minors. If we discover that a user is under 18, we will immediately terminate their account and delete their data.

20. Safety Guidelines & Recommendations

While the Company is not responsible for user interactions, we strongly recommend the following safety practices:

• Never share financial information, credit card details, or banking information with other users
• Never send money to someone you have met on the Platform
• Always meet in a public place for the first time
• Tell a friend or family member where you are going and who you are meeting
• Arrange your own transportation to and from the meeting location
• Trust your instincts — if something feels wrong, leave immediately
• Report any suspicious, threatening, or inappropriate behavior to us immediately
• Do not share your home or work address until you fully trust the other person
• Be cautious of users who avoid video calls or in-person meetings
• Be aware of romance scams and catfishing attempts

These recommendations are provided for informational purposes only and do not constitute a guarantee of safety. The Company is not liable for any harm that occurs despite following or not following these guidelines.

21. Governing Law

This Privacy Policy shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the competent courts of that jurisdiction.

We may update this Privacy Policy at any time. When we make material changes, we will notify you through the App or via email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Policy.

If any provision of this Privacy Policy is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall continue in full force and effect.

This Privacy Policy, together with our Terms of Service and any other legal notices published on the Platform, constitutes the entire agreement between you and the Company regarding your use of the Service, and supersedes all prior agreements, representations, and understandings.
